Free Florida Bareboat Charter Promotional Sweepstakes

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

1. Eligibility

The Sweepstakes is open only to legal residents of the United States who are at least twenty-one (21) years of age at the time of entry. Employees, officers, and directors of Sponsor, its affiliates, advertising agencies, and immediate family members are not eligible to participate.

2. Promotion Period

The Sweepstakes runs on a monthly cycle. Each monthly period begins on the 16th of the current month at 12:00 AM Eastern Time ("ET") and ends on the 15th of the following month at 11:59 PM ET. Sponsor's computer is the official time-keeping device for this Sweepstakes.

3. How to Enter (No Purchase Required)

To enter, participants must complete the online entry form at onemarinemiami.com/giveaway during the Promotion Period. Limit one (1) entry per person per monthly drawing. To enter without any transactional obligations (Free Alternative Method of Entry "AMOE"), eligible individuals may hand-print their name, complete address, phone number, and email address on a 3×5 card and mail it to: One Marine Group LLC, 2500 NW 39th St, Miami, FL 33142. Mail-in entries must be postmarked by the 15th of the drawing month and received within 5 business days.

4. Winner Selection and Notification

One (1) potential grand prize winner will be selected in a random drawing on or about the 15th of each month from among all eligible entries received during that monthly period. The potential winner will be notified via email and/or telephone within forty-eight (48) hours of the drawing. If a potential winner cannot be contacted or fails to execute the required Grand Prize Release and Bareboat Charter Documents within seven (7) calendar days, an alternate winner may be selected.

5. Grand Prize and Estimated Fair Market Value

The Grand Prize consists of a completely free, one-day bareboat (demise) charter of a vessel selected by the Sponsor to be executed in Florida waters.

Estimated Retail Value (FMV): varies by vessel, announced each drawing period.

The prize includes the bareboat rental of the vessel only. The prize does not include transportation to/from the marina, provisioning, or fuel expenses unless explicitly noted. Blackout dates may apply, including major holidays and peak dates. The charter must be redeemed within 90 days of the drawing date.

6. Mandatory Federal Bareboat (Demise) Charter Compliance

To comply strictly with United States Coast Guard (USCG) federal maritime regulations, the execution of the Grand Prize is subject to the following absolute legal conditions. Failure or refusal by the winner to execute these specific requirements will result in immediate forfeiture of the prize:

  • Demise of Possession: The Winner must execute a standard Bareboat Charter Agreement with the Sponsor. For the duration of the prize charter period, the Winner shall assume full legal command, possession, and operational control of the vessel, acting legally as the "owner pro hac vice."
  • Absolute Freedom of Crew Selection: The Sponsor shall not provide, designate, assign, or command any specific captain or crew members to operate the vessel for the Winner.
  • Captain List Options: The Sponsor may provide the Winner with a broad, non-exclusive list of independent, USCG-Licensed Captains who are pre-vetted by the Sponsor's marine insurance carrier. The Winner has the absolute legal right to: (1) Hire a USCG-licensed captain from the provided list; (2) Hire any qualified, independent USCG-licensed captain not on the list, subject to standard insurance approval; OR (3) Personally operate the vessel, provided the Winner demonstrates sufficient maritime experience to satisfy the Sponsor's marine insurance underwriting requirements.
  • Separate Employment and Compensation: The Winner must enter into a completely independent and separate employment contract directly with the chosen Captain. The Sponsor shall not be a party to any captain or crew employment contract. Any stipend or reimbursement offered by the Sponsor to cover crew fees must be distributed directly to the Winner as part of the cash prize equivalent, and paid by the Winner to the Captain.
  • Passenger Limitation: In accordance with federal uninspected passenger vessel rules, the total number of individuals on board the vessel during the charter shall not exceed twelve (12) passengers, excluding the hired crew.

7. Florida State Law Compliance

  • Florida Sweepstakes Registration: This Sweepstakes has been fully registered, bonded, and filed with the Florida Department of Agriculture and Consumer Services (FDACS) in accordance with Florida Statute Section 849.094, where applicable.
  • Taxation and IRS Reporting: The Winner is solely responsible for all federal, state, and local taxes associated with prize acceptance. Because the prize is awarded completely free, Sponsor will issue an IRS Form 1099-MISC to the Winner for the exact Fair Market Value of the prize if the value meets or exceeds $600.00. The Winner must provide a valid Social Security Number or Taxpayer ID before the prize can be formally transferred.

8. Indemnification and Liability Release

By participating in the Sweepstakes or accepting the Grand Prize, the Winner agrees to release, indemnify, and hold harmless the Sponsor, its parent companies, affiliates, subsidiaries, and marine insurance underwriters from any and all liability, claims, losses, damages, or injuries of any kind arising directly or indirectly from participation in the promotion or the use, operation, or possession of the charter vessel.

9. Privacy and Publicity

Except where prohibited by law, participation in the Sweepstakes constitutes the Winner's advance consent to Sponsor's use of the Winner's name, likeness, and social media handle for promotional and marketing purposes in any media worldwide without additional compensation.

10. Disputes and Governing Law

This Sweepstakes and the accompanying agreements are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any legal actions or proceedings arising out of this promotion shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.

By entering this Sweepstakes, you certify that you have read, understood, and agree to be bound by these Official Rules and the federal bareboat conditions detailed herein.
